These Terms of Service ("Terms") govern your use of the website and online store operated by The Sweet Pie Co. ("we", "us", "our"), based in Auckland, New Zealand. By accessing our website or placing an order, you agree to these Terms.

1. About us

The Sweet Pie Co. sells handcrafted desserts including tarts, fudge, treats, gift boxes, and promotional items through this website. Our registered place of business is Unit C4/710 Great South Road, Manukau, Auckland 2104, New Zealand.

2. Eligibility

You must be at least 18 years old, or have permission from a parent or guardian, to place an order. By using this site you confirm that information you provide is accurate and complete.

3. Products and pricing

• Product descriptions, images, and prices are displayed in New Zealand dollars (NZD) unless stated otherwise.
• We reserve the right to correct pricing errors and to limit quantities per customer or per order.
• Prices may change without notice; the price confirmed at checkout applies to your order.
• GST of 15% is included in the total shown at checkout where applicable under New Zealand law.
• Fresh and perishable items may vary slightly in appearance from photographs due to seasonal ingredients and handcrafting.

4. Orders and contract

Your order is an offer to purchase. A binding contract is formed when we send an order confirmation email or when we begin preparing your order, whichever occurs first. We may decline or cancel an order (for example, due to stock unavailability, delivery restrictions, suspected fraud, or pricing error) and will refund any payment taken.

5. Payment

Payment options available at checkout must be completed before your order is processed unless we agree otherwise (e.g. approved business accounts). You are responsible for any fees charged by your bank or payment provider. We use secure payment processing; we do not store full card details on our servers.

6. Delivery and collection

• Delivery dates, areas, and fees are shown at checkout and must be accepted before placing your order.
• You are responsible for providing a correct delivery address and contact details. Risk in the goods passes to you on delivery to that address or on collection from our premises.
• If no one is available to receive a delivery, we will follow our delivery partner's procedures; additional charges may apply for re-delivery.

7. Consumer law (New Zealand)

Nothing in these Terms limits your rights under the Consumer Guarantees Act 1993 (CGA) where you acquire goods as a consumer. Under the CGA, goods must be of acceptable quality, fit for purpose, and match their description. Our Cancellation & Refund Policy explains how we handle returns and remedies.

If you are acquiring goods for business purposes, the CGA may not apply and you agree that the CGA is excluded to the extent permitted by law.

8. Account use

If you create an account, you must keep your login details confidential and notify us of any unauthorised use. We may suspend or close accounts that breach these Terms or misuse the website.

9. Intellectual property

All content on this website (text, images, logos, designs) is owned by or licensed to The Sweet Pie Co. You may not copy, reproduce, or use it for commercial purposes without our written consent.

10. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect or consequential loss arising from use of the website or delay in delivery outside our control (including events of force majeure). Our liability for any claim relating to an order is limited to the amount you paid for that order, except where liability cannot be excluded under New Zealand law.

11. Privacy

Your personal information is handled in accordance with our Privacy Policy and the Privacy Act 2020.

12. Changes

We may update these Terms from time to time. The version on this page applies to orders placed after the updated date. Continued use of the website constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by the laws of New Zealand. Disputes are subject to the non-exclusive jurisdiction of the New Zealand courts.
